SUBROGATION
When an insurance carrier or employer pays for a loss that someone else caused, it may have the right to recover that money from the party responsible. That right is subrogation. Lytle Soulé & Felty represents insurance carriers, employers, third party administrators, and group self-insurance associations in protecting and pursuing their subrogation interests. From our offices in Oklahoma City, we handle these matters through negotiation and, when needed, litigation in state and federal courts.
Subrogation questions often come up in the same claims our insurance defense and workers’ compensation attorneys handle every day, such as a work injury caused by third party negligence or a vehicle accident paid under an auto policy. We look at what was paid, who was at fault, and what notice and deadlines apply, and we keep clients informed about the cost and likely course of a recovery effort.
Subrogation matters we handle include:
- recovery of workers’ compensation benefits paid because of third party negligence
- protection of subrogation interests when an injured person settles with a third party
- recovery of auto, uninsured motorist, and other insurance payments from the party at fault
- claims arising from trucking and transportation accidents
- claims against parties responsible for defective products or unsafe premises
- subrogation claims arising from construction projects
This is a general description of our subrogation practice. It is not legal advice and is not a promise of any result in a particular matter. To discuss a possible matter, call (405) 235-7471 or use our contact page.
